GENERAL TERMS & CONDITIONS
These terms and conditions ("Terms") apply to MyCareerCoach's website located at https://www.mycc.work and/or https://www.mycareercoach.work and/or any subsequent URL which may replace it (the “Website”), our social media pages or any other access point we make available to you. By accessing and using the Website and/or making a Booking, you agree to be legally bound by these Terms. Please read these Terms carefully. If you have any questions relating to these Terms or require any further information, please contact our support team by email at help@mycc.work.
1. DEFINITIONS
1.1 "Booking" means a booking for Services made by you on our Website.
1.2 "Booking Confirmation" is an email sent to you by us on behalf of the selectedCoach to confirm the Booking.
1.3 "Client" or “User” means an individual who engages a Coach for Services via the Website.
1.4 "MyCC", “MyCareerCoach”, “The Company”,“mycc.work”, "ours", "we" and "us" mean MyCareerCoach Ltd, incorporated in England and Wales with company registration number 12951388 and whose registered office is at 20-22 Wenlock Road, London, N1 &GU.
1.5 "Deposit" means the price of the relevant Session.
1.6 "Coach" means a self-employed professional coach or induviduals that have sufficient experience to be recognized as an expert in a certain topic or other career services provider available to book through our Website.
1.7 "Services" means career coaching services, branding services or any other career improvement services available through our Website.
1.8 "Session" means each occurrence of one to one contact time between you and a Coach.
1.9 "you" , "your" and "yours" mean any user of the Website, including Clients and Coaches.
1.10 “Member” or “Members” means users of the system, regardless if “Coach” or “Client”.
2. USE OF THE WEBSITE
The mycc.work Platform is an online venue for career coaching where registered users ("Clients") may use our Connection Services and Payment Services to directly interact with one another. You understand and agree that mycc.work is not a party to any agreements entered into between Clients and Coaches, nor is a services broker or agent. Mycc.work has no control over the conduct of clients and Coaches or over any services provided by Coaches or other Members over Platform, and disclaims all liability in this regard to the maximum extent permitted by law.
If you choose to offer services on the mycc.work Platform, you understand and agree that your relationship with mycc.work is limited to being a member and an independent, third-party contractor, and not an employee, agent, joint venturer or partner of mycc.work for any reason, and you act exclusively on your own behalf and for your own benefit, and not on behalf of or for the benefit of mycc.work. Mycc.work does not control, and has no right to control, your listing, your activities associated with your profile or listed services, or any other matters related to any services that you provide.
As a Member you agree not to do anything to create a false impression that you are endorsed by, partnering with, or acting on behalf of or for the benefit of mycc.work, including by using any mycc.work intellectual property in an unauthorized or inappropriate manner.
2.1 You are provided with access to the Website in accordance with these Terms and any Booking is made in accordance with these Terms.
2.2 We reserve the right to alter, suspend or remove, temporarily or permanently, the Website (or any part thereof) with or without notice to you and we shall not be liable to you or any third party for any such modifications to the Website.
2.3 We may change these Terms from time to time. Revised Terms will be labelled with a new edition date and such changes will be effective when we post the updated Terms on the Website, unless otherwise required by applicable law. By using the Website and/or making a Booking, you will be deemed to be subject to the Terms in force at that time.
3. THE CAREER COACHING PLATFORM
3.1 We act as a booking agency for self-employed Coaches. Our contract with Coaches and Clients is limited solely to provision of use of our Website.
3.2 Individual Coaches are responsible for providing Services to Clients and there is a direct contract concerning the provision of Services between a Client and the relevant Coach(es). The Client and the relevant Coach(es) are responsible for any taxes arising as a result of provision of any Services.
3.3 We have carefully selected the Coaches available for Booking through the Website. We conduct interviews and undertake background checks of Coaches, with these checks reliant on information obtained from third parties. We require all Coaches to provide valid and up to date professional indemnity insurance details, qualifications and right to work status documents. Clients acknowledge that we do not and cannot guarantee the accurateness or completeness of such checks, whether conducted by us or by third parties. Clients acknowledge that they book Coaches at their own risk.
3.4 Coach provides Services through the mycc.work Platform. If you are accepted to be a Coach or Expert, you agree to mycc.work Coach Policy. All Members hereby acknowledge that the Services are solely provided by Coaches and are not provided by mycc.work. Mycc.work’s responsibility with respect to Services is limited to facilitating the availability of the booking Platform.
4. BOOKING SERVICES
4.1 Mycc.work’s services involves connection services between parties. Mycc.work provides Members with access to and use of the Platform, which is an online venue where Members can conduct searches, connect with, choose, evaluate, and engage with Coaches directly for the purpose of learning or enhancing skills that may be useful for career growth.
For the avoidance of doubt, in providing the Connection Services, mycc.work only provides the venue for Members, including Clients and Coaches, to find and contract with each other, and mycc.work does not take part in direct interactions between Members.
4.2 By making a Booking through the Website, Clients confirm that:
4.3 All Bookings made via the Website must be made by paying the relevant Deposit in advance.
4.4 All proposed Bookings are conditional and subject to acceptance by the requested Coach. We will confirm such acceptance to Clients by sending a Booking Confirmation as soon as possible. The contract between a Client and the relevant Coach is only formed when we send you the Booking Confirmation.
4.5 If a Client's requested Coach is unable to accept their proposed Booking, Clients will have the option of either having their Deposit refunded or their Deposit being used towards booking a Session with another of the Coaches available.
4.6Client can also register to become a Member by logging into your account with certain third-party sites including, but not limited to, Google and WeChat, through our Sites or Applications. If a Third-Party Account or associated service becomes unavailable or mycc.work's access to such Third-Party Account is terminated by you or the third-party service provider, then you will no longer be able to log into the Platform through such Third-Party Account, and mycc.work cannot guarantee that user’s dataon the platform is fully preserved. Mycc.work is not liable for any losses that may occur in relation to such termination.
4.7 MEMBERS ARE ENTIRELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF THEIR USERNAME AND PASSWORD AND ALL ACCESS TO AND USE OF THEIR MYCC.WORK ACCOUNT, INCLUDING ANY AND ALL ACTIVITIES (INCLUDING USE OF THE PLATFORM, AS APPLICABLE) THAT ARE CONDUCTED THROUGH THE USE OF YOUR USERNAME AND PASSWORD WHETHER OR NOT AUTHORIZED BY MEMBER. MEMBER’S MYCC.WORK ACCOUNT MAY BE SUSPENDED OR TERMINATED IF IT IS DISCOUVERED THAT MEMBER OR SOMEONE ELSE USES THE ACCOUNT TO ENGAGE IN ACTIVITY THAT VIOLATES THESE TERMS.
4.8 WHILE WE USE GOOD FAITH EFFORTS TO CONFIRM THAT EACH MEMBER AND/OR COACH ON THE MYCC.WORK PLATFORM IS PROFESSIONAL, WE ARE NOT ABLE TO PROVIDE ANY ASSURANCES REGARDING THE CHARACTER OR OTHER QUALITIES OF MEMBERS AND/OR COACHES AND THE ACCURACY OF THE INFORMATION PROVIDED VIA THE MYCC.WORK PLATFORM. WHEN INTERACTING WITH OTHER MEMBERS AND/OR COACHES YOU SHOULD EXERCISE CAUTION AND COMMON SENSE TO PROTECT YOUR PERSONAL SAFETY AND PROPERTY, JUST AS YOU WOULD WHEN INTERACTING WITH OTHER PERSONS WHOM YOU DON’T KNOW. NEITHER MYCC.WORK NOR ITS AFFILIATES OR LICENSORS IS RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY MEMBERS OF THE MYCC.WORK PLATFORM. MYCC.WORK AND ITS AFFILIATES AND LICENSORS WILL NOT BE LIABLE FOR ANY CLAIM, INJURY OR DAMAGE ARISING IN CONNECTION WITH YOUR USE OF THE MYCC.WORK PLATFORM.
5. PRICES AND PAYMENT
5.1 The prices of Services will be as quoted on our Website, except in cases of obvious error.
5.2 Prices may change from time to time, but changes will not affect Bookings in respect of which we have already sent Clients a Booking Confirmation.
5.3 Users may be able to acquire bundle packages, and mycc.work will endeavour to assure the proper utilization of such packages, however it is Client’s responsibility to be attentive to any misutilization of its sessions. Each session booked using bundle packages will cause an email message to sent to Client’s email address confirming the booking and use of such session. Mycc.work also provides certain payment processing services, credit purchase and payment tools. Such service may controlled and executed via third party. In case unauthorized use of the account is detected, Member to immediately notify mycc.work according by sending email to help@mycc.work
5.4 Reasonable efforts have been made to ensure that making a Booking is secure. However, we cannot be responsible for fraudulent use on our Website of a lost payment card.
5.5 As a Client, when you confirm a Lesson was successful, you confirm that the Coach has completed the applicable Session Services fully and satisfactorily, and you are instructing mycc.work to transfer the applicable credits to the Coach. Authorized payments are final. No refunds will be given once session has occurred, even in case of no-show from Client.
5.6Mycc.work reserves the right to seek reimbursement from any Client or Coach, if Mycc.work, in its sole discretion, determines that erroneous or duplicate transactions have occurred. Mycc.work may obtain such reimbursement by deducting from future payments owed to such Coach, , or by seeking reimbursement from such Coach by any other lawful means.
6. Session Contract
6.1 Upon confirmation of the Booking, time, and price by both the Client and the Coach, such Client and Coach shall be considered as entering into a contract, pursuant to which the Client agrees to purchase, and the Coach agrees to deliver, the Career Services (the "Session Contract"). You agree not to enter into any contractual provisions that conflict with the mycc.work Terms or other mycc.work Policies. The Client and Coach each covenant and agree to act with good faith and fair dealing in performance of the Session Contract. Furthermore, the Client and Coach each acknowledge and agree that the value, reputation, and goodwill of the Platform depends on their performance of the foregoing covenants and agreements. The Client and the Coach therefore agree that mycc.work has the right to take such actions with respect to the Session Contract, including without limitation suspension, termination, or legal actions, as mycc.work in its sole discretion deems necessary to protect the value, reputation, and goodwill of the Platform.
6.2 Feedback and Ratings on Sessions: As a Client, when you confirm a Session was successful, you may be asked to leave feedback and a rating for the Coach. Leaving feedback or a rating is optional. However, if you do so, you agree that your feedback must be genuine and honest, and will not commit fraud, spam, insult, harass, threaten, or otherwise misuse the feedback system. You agree to report violations or abuses of our rating and feedback system by contacting Customer Service, and agree not to take any actions that undermine the integrity of the feedback system.
6.3 Dispute: In the event of a disagreement between a Coach and a Client, mycc.work encourages the parties to communicate directly and attempt to resolve the disagreement. If a Coach and Client are unable to resolve a disagreement and mycc.work is asked to mediate, mycc.work may request that both parties to provide communication records regarding the dispute, which should show all key relevant information including the time, date and communication details. Although mycc.work will attempt to evaluate the dispute on an impartial basis, mycc.work will have the authority to resolve the dispute in its sole discretion, and its resolution of the dispute will be final. Mycc.work shall have the right, in its sole discretion:
1. To transfer credits, offer a refund, or reverse a transaction. 2. To designate who shall bear the Commission Fee resulting from any such actions.
7. BOOKING CANCELLATION
7.1 Booking Cancelation by the COACH: If, after Booking and receipt of a Booking Confirmation, the Coach is unavailable for a Session, we will endeavour to find the relevant Client a replacement Coach for that Session or alternatively the Client will be able to reschedule for another date or request for a refund of deposit.
7.2 Booking Cancelation by the Client: Clients can cancel a Booking for any reason up until 4 days (96 hours) before the start time of a Session without a cancellation fee being charged. Clients will have the option of either having their Deposit refunded or their Deposit being used towards booking an alternative Session with that Coach or another of the Coaches.
7.3 Clients may reschedule a Booking with the same Coach up until 2 days (48 hours) before the start time of a Session without a cancellation fee being charged. After a Booking has been rescheduled, it cannot be rescheduled again and paragraph 7.3 below will apply to such Booking.
7.4 For cancellations within 2 days (48 hours) before the start time of the Session (or in case of Client no-show), the Client will lose their Deposit as a late cancellation fee in order to compensate the Coach for the loss of opportunity of alternative work.
8. THIRD PARTY LINKS
Links to third party websites on the Website are provided solely for your convenience. If you use any such links, you leave the Website and you do so entirely at your own risk. We do not control and are not responsible for third party websites or their content or availability. We therefore do not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them.
9. PRIVACY
We process information about you in accordance with our Privacy Policy. By using the Website, you consent to such processing and confirm all data provided by you is accurate. You represent that you have read and understood our privacy policy ("Privacy Policy"), which is available at https://www.mycc.work/privacy. Note that we may disclose information about you to third parties if we have a good faith belief that such a disclosure is reasonably necessary to (i) take action regarding suspected illegal activities; (ii) enforce or apply our Terms or other Policies (as hereby defined or in the mycc.work website); (iii) comply with legal process or other government inquiry, such as a search warrant, subpoena, statute, judicial proceeding or other legal process served on us; or (iv) protect our rights, reputation, and property or that of our users, affiliates or the public.
10. DISCLAIMER OF LIABILITY
10.1 We will not be liable in the event of any damage or loss caused by a Coach, howsoever caused. Each Coach listed on the Website holds private indemnity and public liability insurance.
10.2 We have a £1,000,000 public liability insurance policy underwritten by a leading insurer. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of Bookings and payment secure, but we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or making a Booking on the Website
10.3 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract between a Client and a Coach.
10.4 IN NO EVENT SHALL MYCC.WORK OR THE COACHES BE LIABLE TO YOU OR ANY OTHER MEMBER FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES PURSUANT TO THESE TERMS, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITIES OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW FOR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU
10.5 NOTWITHSTANDING ANY OTHER PROVISION OF THESE TERMS, IN NO EVENT WILL OUR LIABILITY TO YOU FOR ANY ACTION OR CLAIM RELATED TO THE PLATFORM PROVIDED UNDER THESE TERMS, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE OR ANY OTHER THEORY OF LIABILITY, EXCEED IN THE GREATER OF: (A) £100 OR (B) THE AGGREGATE AMOUNT OF SERVICE CHARGES ACTUALLY COLLECTED BY US FROM YOU FOR THE SERVICES TO WHICH THE LIABILITY RELATES DURING THE SIX (6) MONTH PERIOD IMMEDIATELY PRECEDING THE DETERMINATION OF SUCH LIABILITY.
11. Restrictions
We are under no obligation to enforce the mycc.work Terms on your behalf against another Member. While we encourage you to let us know if you believe another Member has violated the mycc.work Terms, we reserve the right to investigate and take appropriate action at our sole discretion.

The restrictions above only apply to the extent permissible under applicable law. Nevertheless, you agree not to act contrary to these restrictions (even if permissible under applicable law). Moreover, mycc.work reserves the right to determine what conduct can be considered being in violation of these Terms or otherwise outside the intent or spirit of the mycc.work Platform. Mycc.work reserves the right to take action as a result of any such violation, which may include terminating your Account, seeking indemnification from member and prohibiting member from using the Platform in whole or in part.
12. Disclaimers
12.1 THE MYCC.WORK PLATFORM PROVIDED BY MyCareerCoach Ltd AND THE SERVICES PROVIDED BY ANY COACHES OR EXPERTS ARE PROVIDED ON AN "AS IS," AND AS AVAILABLE BASIS, WITHOUT WARRANTY, AND "WITH ALL FAULTS", WITH THE EXPRESS UNDERSTANDING THAT MYCC.WORK MIGHT NOT MONITOR, CONTROL OR VET MEMBER CONTENT OR ANY CONTENT FROM THIRD PARTY. MYCC.WORK EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES AS TO THE PRODUCTS OR SERVICES OFFERED BY THIRD PARTIES, AND IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OR TRADE. YOUR USE OF THE MYCC.WORK PLATFORM IS AT YOUR OWN DISCRETION AND RISK. WE MAKE NO REPRESENTATIONS OR WARRANTIES, OF ANY KIND, EITHER EXPRESS OR IMPLIED, AS TO THE QUALITY, IDENTITY OR RELIABILITY OF ANY THIRD PARTY, OR AS TO THE ACCURACY OF THE POSTINGS MADE ON THE PLATFORM BY ANY THIRD PARTY. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
12.2 IN ADDITION, NOTWITHSTANDING ANY FEATURE A CLIENT MAY USE TO SELECT A COACH, EACH CLIENT IS RESPONSIBLE FOR SELECTING THEIR COACH AND NEGOTIATING A CONTRACT AND MYCC.WORK DOES NOT PROVIDE ANY WARRANTY WITH RESPECT TO ANY GOODS OR SERVICES PURCHASED BY A MEMBER ON THE PLATFORM AND DOES NOT RECOMMEND ANY PARTICULAR COACH. DESPITE ENDEAVOURING TO CONFIRM ALL INFORMATION PROVIDED BY COACH, MYCC.WORK DOES NOT PROVIDE ANY WARRANTIES OR GUARANTEES REGARDING ANY COACH’S PROFESSIONAL ACCREDITATION, REGISTRATION OR LICENSE.
13. Indemnification
13.1 You agree to indemnify, defend and hold mycc.work harmless, including against all costs, liabilities and legal fees, from any claim or demand made by any third party arising out of or relating to (i) your access to or use of the Platform, (ii) your decision to submit postings and accept offers from other Member, (iii) any breach of contract or other claims made by Members with which you conducted business through the Platform, (iv) your violation of these Terms, (v) any products or services purchased or obtained by you in connection with the Platform, (vi) any liability arising from the tax treatment of payments to Coaches, (vii) any negligent or intentional wrongdoing committed by you on or through the Platform, (viii) any infringement by you, or any third party using your Account, of any intellectual property or other right of any person or entity, (ix) your failure to pay or dispute of any fees owed to any Coach or any other amounts owed to other Members; and/or (x) your failure to satisfy your obligations as a Coach or to a Coach.
13.2 Mycc.work reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify mycc.work and you agree to cooperate with mycc.work’s defense of these claims. You agree not to settle any such matter without the prior written consent of mycc.work. Mycc.work will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of such claim, action or proceeding.
14. Notices
14.1 Unless you otherwise indicate in writing to customer service via help@mycc.work, mycc.work will communicate with you by email or by posting communications on the Platform. You consent to receive communications from us electronically and you agree that these electronic communications satisfy any legal requirement that such communications be in writing. You will be considered to have received a communication when mycc.work sends the communication to the email address you have provided to mycc.work on the Platform, or when mycc.work posts such communication on the mycc.work Platform. You must keep your email address updated on the mycc.work Platform, and you must regularly check the mycc.work Platform for postings. If you fail to respond to an email message from mycc.work regarding violation, dispute or complaint within two business days, mycc.work will have the right to terminate or suspend your mycc.work Account.
14.2 All notices to mycc.work intended to have a legal effect concerning these mycc.work Terms must be in writing and delivered either in person or by a means evidenced by a delivery receipt, to the following address:
Such notices to mycc.work are deemed effective upon receipt.
15. GENERAL
15.1 Unless otherwise stated, all copyright and other intellectual property rights in the content on the Website are owned by or licensed to us. No part of the Website may be reproduced on any other website or stored without our prior written permission.
15.2 If you upload or publish any content to our Website, such as reviews, comments, ratings, profiles or photos, you grant us a worldwide, perpetual, non-exclusive, royalty-free licence to use, copy, alter, adapt or display any such content in any format or through any media.
15.3 We will contact you by email or phone in respect of any Bookings and provide you with information by posting notices on our Website from time to time. All notices given by you to us must be emailed to our contact address at help@mycc.work, notices with legal effect to respect provisions of item 14.
15.4 If any part(s) of these Terms are unenforceable, such provision(s) shall be severed from these Terms and the remainder of the Terms shall remain in full force and effect.
15.5 These Terms constitute the entire agreement between us and the Client and supersede any previous communications or agreements between us.
